By downloading, installing, or using PollenPal ("the app"), you agree to these Terms of Service ("Terms"). You must actively accept these Terms via the in-app consent screen before using the app. If you do not agree, do not use the app.
These Terms form a legally binding agreement between you and Marek Pizner, L. Novomeskeho, Prešov 08001, Slovakia ("we", "us").
PollenPal is a personal allergy management app that provides:
You must be at least 16 years old (EU) or 13 years old (US) to use PollenPal. By accepting these Terms you confirm you meet the minimum age requirement for your jurisdiction.
If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Core pollen forecast features are available for free with no time limit.
EU consumers have a 14-day right of withdrawal from digital content purchases unless the content has been delivered and you have waived this right. You waive the right of withdrawal when you begin using Premium features immediately after purchase.
We will give at least 30 days notice of subscription price increases. You may cancel before the new price takes effect.

PollenPal is not a medical device and does not provide medical advice. It is not a substitute for professional medical consultation, diagnosis, or treatment.
Pollen forecasts are based on third-party meteorological data (Open-Meteo) and seasonal models. Accuracy may vary by location and environmental conditions.
We only send marketing communications if you explicitly opted in. You can withdraw consent at any time as described in our Privacy Policy without losing access to core features.
All content, design, code, trademarks, and data in PollenPal are owned by or licensed to Marek Pizner. You are granted a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works without written permission.
The app integrates third-party services. We are not responsible for their availability or practices:
To the maximum extent permitted by applicable law:
Nothing in these Terms limits or excludes liability for: death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.
If you are an EU consumer, these Terms do not affect your statutory rights under EU consumer protection law, including Directive 2019/770 on digital content contracts. In case of conflict between these Terms and mandatory consumer protection law, the applicable law prevails.

EU consumers may also use the European Commission's Online Dispute Resolution platform.
These Terms are governed by the laws of the Slovak Republic. Disputes shall be subject to the jurisdiction of the courts of Prešov, Slovakia, without prejudice to mandatory consumer protection rights in your country of residence.
We will notify you of material changes via in-app notification or email at least 30 days before they take effect. If you do not accept the updated Terms you may terminate your use of the app. Continued use after the effective date constitutes acceptance.
